● To knowingly transmit any data, send or upload any material that contains viruses, Trojan horses, worms, time-bombs, keystroke loggers, spyware, adware or any other harmful programs or similar computer code designed to adversely affect the operation of any computer software or hardware;
● To send, knowingly receive, upload, download, use or re-use any material which: • is defamatory of any person;
● Is obscene, offensive, hateful or inflammatory;
● Promotes sexually explicit material;
● Promotes violence;
● Promotes discrimination based on race, sex, religion, nationality, disability, sexual orientation or age;
● Infringes any copyright, database right, trade mark or other intellectual property right of any other person;
● Is likely to deceive any person; ● Is made in breach of any legal duty owed to a third party such as a contractual duty or a duty of confidence;
● Promotes any illegal activity;
● Is threatening, abusive or invades another’s privacy, or causes annoyance, inconvenience or needless anxiety;
● Is likely to harass, upset, embarrass, alarm or annoy any other person;
● Advertises for sale substances that are legal in law but are known to be abused;
● Is used to impersonate any person, or to misrepresent your identity or affiliation with any person; or gives the impression that it emanate from us if this is not the case.
You also agree not to access without authority, interfere with, damage or disrupt:
● Any part of our site;
● Any equipment or network on which our site is stored;
● Any software used in the provision of our site;
● Any equipment or network or software owned or used by any third party.
You may not register for an account with us or sign up or use our services for the purposes of testing or vetting security measures in any way or format without our express written consent to do so.

The purpose of the web hosting space provided is for use with web hosting and all files uploaded or stored must comply with this requirement and be visible and accessible to end users visiting the web site or domain.

Web Hosting and WordPress Hosting plans are designed to host most personal, small business and organization websites, and so we offer unlimited bandwidth and some plans offer unlimited disk space and websites. This means that we do not set a limit on the amount of bandwidth, websites or disk space you may use in the operation of your website, provided it complies with this acceptable usage policy and our terms and conditions of service. But we use a Fair Use policy for Disk Space.

In the event the bandwidth, number of websites or disk space usage of your website presents a risk to the stability, performance or uptime of our servers, data storage, networking or other infrastructure, you may be required to upgrade to a VPS or Dedicated Server, or we may take action to restrict the resources your website is utilizing.

The web hosting space will not be used as a file storage method for purposes other than serving content for your web site and in any event may not contain the following content;

● Warez' content or content commonly known to be pirated or illegal copies of software or other works;
● MP3’s or other audio formats of copyrighted music;
● Movie downloads in any format whether complete or in part;
● Pornographic material; ● Any content that is illegal under UK or European law;
● Image hosting scripts that allow an anonymous user to upload an image for display on another website;
● Banner advertising services for display on other websites or devices (commercial banner advertisement rotation);
● File dump/mirror scripts that allow anonymous users to upload a file for others to download; ● Commercial audio streaming (more than one or two streams);
● Push button mail scripts that allow the end user to specify recipient email addresses;
● Anonymous or bulk SMS gateways;
● Backups of content from a computer or website; ● Bittorrent trackers
● Any script that causes a degradation in the performance of our server or network environment;

We reserve the right to serve notice to suspend service, suspend service, or remove any files which do not comply with these rules

Our shared and reseller hosting, also encompassing our email only hosting plans, are provided with email services and facilities. The maximum permissible emails that can be sent out in any single hour is 300 from a domain. We do not provide catch all mailboxes as these are commonly spam magnets. For windows hosting customers, all emails from deleted items will be deleted at 15 days age, Sent Items at 30 days age, inbox 365 days and spam folder 7 days. however these default settings can be changed. Each email sent must have 40 or less recipients. The total email allowance per domain name is 1024mb. this means all mailbox’s together must not exceed 1024mb, however we can increase this to 2048mb if proven more space is needed, this is on a per domain basis. Whilst our standard email services as supplied with our shared and reseller hosting plan are typically of high quality and features we do not warrant them in any way.

Mass mailing is not allowed on hosting servers. A dedicated mass email server can be provided with the use of unlimited SMTP for sending via programmatic means from shared hosting on our web sites if required. Anyone who sends mass mail and is found to have caused problems affecting Hosting UK mail servers or IP reputation will be subject to a fine and have their domain and service suspended.

Any user who by their action or inaction and who's services are found to be sending spam emails will be levied a fine of $100.00 to cover HZMFR's time in performing any clean-up action required to our mail servers. Any user who by their action or inaction and who's service causes IP black listings may be given a fine of up to $200.00. Any user who by their action or inaction and who's services result in complaints from other companies, for example spamcop, aol, yahoo etc. may be given a fine of not less than $100.00 to cover administration fee’s for HZMFR time.

Any customer who's database service usage results in excessively high server resource utilisation to the detriment of service or to our other customers will have their database suspended pending remedial action. The onus is on the customer to monitor database space usage and take action to ensure they do not exceed their database limits. We expect that any databases will be in use with a web site and will be maintained. There should be no more than 1,000 tables per database and no more than one gigabyte of storage per database. Any service found to exceed storage limits may result in the suspension of services.

Where this occurs we will unsuspend services on request providing that remedial action is taken by the customer to return the services back within limits. Should such action not be taken as required and a further suspension be made an administration fee of $50.00 may be levied for our time. Where overuse occurs we reserve the right to charge for space used over and above allowances in order to prevent future suspensions or to charge for future unsuspensions at the rate of $50.00 per instance.

Proxy services are often used to hide the originating users true IP address or location. Unfortuantely this presents us with a number of issues relating to our obligations relating to security, finance and taxation and so accessing our services via proxy services is expressly prohibited. Where we find proxy services have been used to sign up for an account or to otherwise disguise the location of the account holder we reserve the right to terminate any accounts and services used in this manner without notice.

We will always do our best to be respectful and in our dealings with you, by email or by phone, treat you in the manner in which we ourselves would expect to be treated. We fully expect that our customers will treat us the same way.

That can be a challenge sometimes for both parties as we recognise that things can sometimes get frustrating. Computers do have errors (often caused by humans) and humans also make mistakes from time to time. Whether those computers or humans are either yours or ours, we expect that both parties will remain calm and deal with any issues that occur professionally.

On rare occasions a customer will become threatening or abusive. This can manifest itself in the use of all capitals in email (considered in general internet terms as shouting) or the use of abusive language. On the phone this includes shouting and abusive language.

On such occasions we reserve the right not to answer the email or to hang up. We don't need any abuse (the job can be challenging enough) and simply won't tolerate it. If a customer feels the need, do as we do - leave your desk and go for a walk. Breath. Talk to somebody and vent if you need to - just not at us.

We understand that social media is a great place to voice opinions, however we it''s also often used as a platform to berate and abuse companies and to extort them with negative PR. This is often to push them into giving people their own way, whether that's jumping a queue or getting products or services at a discount.

Abusing us on social media is also something we have a zero tolerance against. We wouldn't dream of abusing you over social media, so we don't expect our customers to abuse us. We understand that people may use it to voice dissatifaction however we expect that customers remain civil and act with civility at the very least, as we will.

Abusive behaviour over social media may result in termination of your account. If appropriate we may also report offensive comments or behavior to the relevant authorities.

We will determine, in our sole discretion, whether you have breached this acceptable use policy. When a breach of this policy has occurred, we may take such action as we deem appropriate.

Failure to comply with this acceptable use policy constitutes a material breach of our Standard Terms and Conditions and, in addition to our rights contained therein, may result in our taking all or any of the following additional actions:

● legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
● Further legal action against you;
● Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

We exclude liability for actions taken in response to breaches of this acceptable use policy. The responses described in this policy are not limited, and we may take any other action we reasonably deem appropriate.

If you have a complaint then there are ways in which you can address them.

Your first port of all is an email to info@hzmfr.com with full details of your complaint. You should make sure you provide as much detail as possible including a timeline of events if applicable, the details of any of our team that you have dealt with, any relevant trouble ticket numbers and the time and date of any phone calls. In short, as much information as you can to help us conduct a thorough review of your complaint.

The complaint will be received and reviewed by a manager who will consider all of the information available and who may contact you to ask further questions if appropriate.

We will do everything we can to deal with any complaint raised and if we can find a way to resolve any issue to your satisfaction we will.

Although we try our best, and although we know both ourselves and our customers have the best intentions at heart, things might get to a point where they are not working out for either party.

It may be that you just cannot understand our systems or processes or perhaps you can't understand how to use things. It may be that we, try as we might, cannot satisfy your requirements.

Just as you can leave or choose not to renew your services with us without giving a reason we may decide that in everyones best interest and to avoid further anguish we will not renew your service with us.

Of course we really hope and will try our best to ensure that things don't get to that stage, however if they do, we'll be sure to give you at least a months notice to give you a chance to make alternative arrangements.

We may revise this acceptable use policy at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we make, as they are legally binding on you and form part of your contract with us. Some of the provisions contained in this acceptable use policy may also be superseded by provisions or notices published elsewhere on our site.

HZMFR provides web hosting, domain registration, reseller hosting, VPS hosting, Cloud hosting and SSL certificates. All customers should agree on all terms and conditions stated prior to their signing up for any of the hosting plans and services mentioned on HZMFR. You shall agree to use only licensed and legal third party softwares in connection with your use of our services. HZMFR reserves the right to suspend or cancel a customer’s access to any or all services provided, at any time, or when HZMFR decides that the account has been inappropriately used or otherwise.

Customer agrees that they will protect, indemnify, save and hold HZMFR harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable attorney’s fees assessed against HZMFR , its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by it’s customers, agents, employees or assigns.

Customer agrees to defend, indemnify and hold HZMFR harmless against liabilities arising out of –

● Any injury to person or property caused by any products sold or distributed in association with HZMFR Services;

● The loss of any electronic files furnished by customer (Or customer’s customer);

● Copyright violation and any defective products sold to a customer from HZMFR’s Services

HZMFR reserves the right to refuse service and/or access to its servers to anyone. The services provided by us must be used for lawful purposes only. Transmission, storage, or presentation of any information, data or material in violation of any DK law is prohibited. The list of banned content includes, but is not limited to :-

Illegal Material – This includes copyrighted works, commercial audio, video, or music files, and any material in violation of any regulation or material that is perceived to be misleading.

Warez – This includes, but is not limited to, pirated software, ROMS, emulators, phreaking, hacking, password cracking, IP spoofing and encrypting of any of the above. Also includes any sites which provide “links to” or “how to” information about such material.

IRC Hosts – Hosting host an IRC server that is part of or connected to another IRC network or server or have a connection to an IRC network. Servers or Virtual hosting accounts, found to be connecting to or part of these networks will be immediately removed from our network without notice. The server would not be reconnected to the network until such time that you agree to completely remove any and all traces of the irc server, and agree to let us have access to your server to confirm that the content has been completely removed. Any server guilty of a second violation would result in immediate account termination.

We do not allow any kind of mining activity (Data mining, Crypto currency mining) on our servers.

Prohibited Contents also includes, but is not limited to :

● Any Automated Bots
● Warez Sites
● Hate Sites
● Child Pornography

Use of our service to transmit any unsolicited commercial or unsolicited bulk e-mail is expressly prohibited. Violation of this SPAM policy will result in severe penalties.

Upon notification of an alleged violation, we will initiate a full scale investigation during which, we may restrict customer’s access to the network to prevent further violations. If a customer is found to have violated our policy, we may, at our sole discretion, restrict, suspend or terminate the guilty hosting account. Further more, we reserve the right to pursue civil remedies for any costs associated with the investigation of a substantiated policy violation. We will notify law enforcement officials if the violation is believed to be a criminal offense. Anyone using our service to host websites or services that support spammers or cause any of our IP space to be listed in any of the various Spam Databases will have their account(s) immediately suspended and an administrative fee of $250.00 will be charged to your account. The account will not be unsuspected until such time that you agree to remove any and all traces of the offending material immediately upon reconnection. First violations of this policy will result in a warning and your account will be reviewed for possible immediate termination. A second violation may result in an immediate termination of your account and the administrative fees will be $500. Severe violations may result in immediate and permanent removal of the account(s) from our network without notice to the customer.

We have a zero tolerance policy for the use of our service towards posting of messages or commercial advertisements which violate the rules, regulations, or charter of any newsgroups or mailing list. Commercial messages that are appropriate under the rules of a newsgroup or mailing list or that are solicited by the recipients are permitted.

We also prohibit hosting of publicly-accessible “open relay” SMTP or anonymous remailer service for any purpose, cause, or reason what-so-ever.

If the customers account exceeds the bandwidth limit, we would inform the customer. If the customer does not wish to purchase extra bandwidth or upgrade his account and continues to exceed their limit, the account shall be suspended until the customer takes measures to ensure that the limit wouldn’t exceed again or when the account is upgraded, which ever is earlier. The account would be reactivated in the following month.

If the customer fails to complete the account verification process then no refund would be provided to such customers under any circumstances.

“Unlimited” usage policies and definitions apply only to shared and reseller hosting accounts.

The size of each mail box should not exceed 5GB and combined mail box size per domain should not exceed 50GB. This is applicable for Linux & Windows based shared (Valued and Unlimited), reseller & hosting (Silver, Gold, Platinum) plans.

Any service interruptions or downtime due to scheduled maintenance by HZMFR or our network providers will not count towards the uptime guarantee. HZMFR is not liable in any way for failure of third party services.

HZMFR will not be liable for failure or delay in performing its obligations if such failure or delay is due to circumstances beyond its reasonable control, including but not limited to acts of any governmental body, war, insurrection, sabotage, embargo, fire, flood, strike or other labour disturbance, interruption of or delay in transportation, unavailability of, interruption or delay in telecommunications or third party services (including DNS propagation), failure of third party software or hardware or inability to obtain raw materials, supplies or power used in or equipment needed for provision of the Services.

We perform daily backups for all ours clients on Amazon S3 servers for all domains hosted on our servers via Jet-backups and those backups remain for 1-3 days, accounts should not exceed 3.5 GB of disk space, other than that if you like to make a daily backups for a specific account higher than 3.5 GB please contact us to find a special offer for you.

You are responsible for any misuse of your account therefore, you must take steps to ensure that others do not gain unauthorized access to your account. In addition, you may not use your account to breach the security of another account or attempt to gain unauthorized access to another network or server.

Your password provides access to your account. It is your responsibility to keep your password secure.

Sharing your password and account access with unauthorized users is not recommended. You should take care and prevent others from using your account since you will be responsible for the consequences.

Attempting to obtain another user’s account password is strictly prohibited, and will result in termination of service.

You must adopt adequate security measures to prevent or minimize unauthorized use of your account.

You may not attempt to circumvent user authentication or security of any host, network or account. This includes, but is not limited to, accessing data not intended for you, logging into or making use of a server or account you are not expressly authorized to access, or probing the security of other networks. Use or distribution of tools designed for compromising security is prohibited. Examples of these tools include, but are not limited to, password guessing programs, cracking tools or network probing tools.

You may not attempt to interfere with service to any user, host or network (“denial of service attacks”). This includes, but is not limited to, “flooding” of networks, deliberate attempts to overload a service, and attempts to “crash” a host. Users who violate systems or network security may incur criminal or civil liability.

HZMFR will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations.

If paying via credit card, debit card, PayPal the account will be setup immediately once the payment is confirmed.

The 30 day money back guarantee is only applicable for first-time signups. Second time and subsequent sign-ups are not eligible for the same. For instance, if you’ve had an account with us before, cancelled and signed up again, you will not be eligible for a refund or if you have opened a second account with us.

There will be no refund for domain registration/transfer/renewal, cPanel, Plesk, Webuzo, Control Panel, Cloud, VPS, Dedicated Server, Paid Support, SSL Certificates, SpamExperts, Windows OS, SQL, and any other paid licenses (if apply).

The money back guarantee is provided on Shared hosting, Reseller hosting, WordPress hosting and Email hosting (if apply).

There is NO money back guarantee on All [ VPS Server ] Parchases.

No refund will be made if your Service(s) are suspended or terminated for cause.

The refund will not cover any kind of taxes, setup fees, refund processing fee, in case the web hosting account was involved in violation of our terms of service or any kind of illegal or system resources over-usages or after 30 days period or beyond coverage of our refund policy as noted here.

Domain is offered with purchase of every new Value/Unlimited plan for 1/2/3 years. Domain will be free till the web hosting plan remains in active status (if apply).

The cancellation request should be sent through client area.

After sending the cancellation request, it would take 4 – 5 working days to complete the process.

Once it’s approved you may continue using your service till the end of your next billing, after that your service will be terminated.

Please remember to make backup for your files before the terminations day !!

We are not responsible of any loss of data after termination day.

We may have a backups of your Data's up 48 hours after termination on jetbackups.

But it’s not 100% guarantee.

If the web hosting service includes free domain name, and you cancel the web hosting service, the domain charges (standard rate as per website) would be deducted from the refund amount. If the refund amount is less than the domain name price, you will have to pay the difference or forfeit the domain. The ownership of the domain will remain with HZMFR if you fail to pay the difference amount.

Transfer fees would be applicable, if you wish to transfer the free domain name to some other provider. Without transfer fees the domain will not be released.

The refund request placed after 30 days will not be processed and you will not be eligible for any refund.

When a refund is processed, it will not ‘post’ or be visible in your online banking account, even if the Merchant refunded immediately. It might take it 3-14 days due to different card issuers’ processing efficiency and their work flow. Usually the Merchant’s refund cycle is batched once daily, possibly delayed a day or two, to submit all the refund to the acquirer.
